Personal data as defined by the GDPR and the German Data Protection Act comprise all information with which you can be personally identified. The personal data processed to run our online shop particularly include the following:

  • Your order details, the products you have purchased, services you have used, payment information, your preferences relating to product types,

Origin of your personal data

Personal data are collected directly from you. This is done, for example, during the ordering process or when you subscribe to the newsletter.


Legal basis and purposes of the processing

The legal basis for processing your personal data is Article 6 Paragraph 1 Letters a and b of the GDPR. You provide us with the data on the basis of the contract relationship (for example to manage your customer account or complete a purchase contract) between you and us. We must process your e-mail address in the event that you place a purchase order with us as a result of the statutory provisions in the Civil Code (BGB) as we have an obligation to send you an electronic order confirmation (Article 6 Paragraph 1 Letter c of the GDPR).

Processing on the basis of the justified interests (Article 6 Paragraph 1 Letter f of the GDPR) of camel active comprises the use and analysis of your personal data for the following purposes:

  • Action to improve and develop services and products to enable us to offer you a tailored experience with appropriate offers and products

Use of data for the purposes of credit checks and sending to credit agencies

Bültel Worldwide Fashion GmbH & Co. KG generally enables its customers to purchase goods using insecure payment methods (for example payment on receipt of invoice). This means that Bültel Worldwide Fashion GmbH & Co. KG has a justified interest in protecting itself as well as possible from non-paying customers. This is done by various methods, including checking the creditworthiness of the customer before enabling them to use insecure payment methods and using the information received during the ordering process to calculate the probability of non-payment.

This check is carried out by Arvato Payment Solutions GmbH, Gütersloher Str. 123, 33415 Verl in conjunction with informa solutions GmbH, Rheinstrasse 99, 76532 Baden-Baden and infoscore Consumer Data GmbH, Rheinstr. 99, 76532 Baden-Baden. Your data are processed for this credit check on the basis of Article 6 Paragraph 1 Letters b and f of the GDPR.


Use of data for fraud prevention purposes

The data provided by you during an ordering process may be used to check whether it is an atypical order process (for example the simultaneous order of a wide range of goods for the same address using different customer accounts). In principle, we have a justified interest in carrying out these checks. The legal basis for processing these data is Article 6 Paragraph 1 Letter f of the GDPR.

Furthermore, Bültel Worldwide Fashion GmbH & Co. KG processes personal data to meet its legal duties (for example under commercial or fiscal legislation) on the basis of Article 6 Paragraph 1 Letter c of the GDPR.


Disclosure of your data to third parties

Personal data are only disclosed or transferred for the purposes set out above and on the basis of the statutory permission specified in each case. Service providers who work on our behalf have been carefully selected by us and can be placed in the following categories:

The data are transferred as part of the order processing procedure. camel active obliges its service providers to process the data securely, confidentially and in compliance with the law. The legal basis for processing these data is Article 6 Paragraph 1 Letter b of the GDPR.


Transferring data to transport service providers

We work with logistics service providers, transport contractors and shipment partners for the purpose of delivering goods which have been ordered from us. The following data may be sent to these partners for the purposes of delivering the ordered goods or providing notification of delivery: Forename, surname, mailing address, e-mail address. The legal basis for processing these data is Article 6 Paragraph 1 Letter b of the GDPR.


Storage duration and deletion

Personal data are stored for the above purposes for the period required to fulfil the purposes and unless there are any other statutory storage duties (under the Commercial Code or Tax Code) or legal reasons for storing the data. This means that camel active will delete your personal data at the latest after the elapse of its statutory storage obligations, generally 10 years after the end of the contract.

 

4. Data processing when our website is visited

Each time you visit our website (even if our website is used for information purposes) we collect access data and information which your browser provides automatically. These usage data are saved in protocol files (so-called server log files). The data records saved by this process particularly include the following:

  • User’s browser type and version,
  • User’s operating system,
  • User’s IP address and internet service provider,
  • Date and time of access,
  • Websites from which the user’s system accesses our website,
  • Websites opened by the user’s system via our website.
These data are saved in our system’s log files. These data are not stored together with other personal data referring to the user.

The legal basis for the temporary storage of the data and the system log files is Article 6 Paragraph 1 Letter f of the GDPR. The data are saved in system log files to maintain the function of our website. In addition, these data are used by us to improve our website and ensure the security of our IT systems. The data are not evaluated for marketing purposes in this respect.

The data are deleted as soon as they are no longer required to achieve the purpose for which they were collected. If the data is stored in system log files, this is the case after seven days at the latest. The data may be stored beyond this time. In this case, the users’ IP addresses will be deleted or anonymised so that they can no longer be used to identify the clients who have visited the website.

 

5. Data processing to complete a purchase order

If you wish to order something in the camel active online shop, you can choose whether you enter the data required for the order on a one-off basis (guest order) or whether you wish to create a password-protected customer account in which your data are saved for later additional purchases.

Your personal data are recorded in an entry mask, sent to us and saved. The following personal data are mandatory for your order:

  • Title,
  • Forename,
  • Surname,
  • Street, house number, postcode, town, state (invoice address or delivery address if different),
  • E-mail address.
It is not possible to place an order without entering the data required in the mandatory boxes. In addition, the user’s IP address and the date and time of access will also be saved.

We use your data to complete orders, provide additional services requested by you, offer various payment options and complete the payment as well as any reimbursements and various marketing offers (see also the point headed "Data processing for marketing purposes"). The legal basis for processing the personal data relating to creating a customer account is Article 6 Paragraph 1 Letter b of the GDPR.


External payment service providers
The payment data are transferred and processed by external payment service providers for the purposes of completing the payment. The use of external payment service providers enables us to offer you a selection of different payment methods and therefore to make the payment process more flexible both for you and for us. This is also in our justified interest.

If you have granted us your consent, the legal basis for processing the data is Article 6 Paragraph 1 Sentence 1 Letter a of the GDPR. If the above data are processed to conclude and complete the contract relationship, the legal basis is Article 6 Paragraph 1 Sentence 1 Letter b of the GDPR. Otherwise, the legal basis is Article 6 Paragraph 1 Sentence 1 Letter f of the GDPR.

You may revoke any consent you have granted us at any time. You can refuse us permission to process your personal data at any time. However, we would point out that unless you send us the payment data and/or enable the payment service provider to process the data, we will be unable to provide you with any method of payment and therefore it may not be possible to fulfil the contract with you.


BS PAYONE

To complete the payment process, we send the payment data supplied by you to BS PAYONE GmbH, Lyoner Strasse 9, 60528 Frankfurt/Main, Germany; Concardis GmbH, Helfmann-Park 7, 65760 Eschborn, Germany.

Your payment data are sent to servers operated by our payment service provider in the European Union and are also processed there. This ensures that the European data protection law standards and regulations are satisfied. Further information is available at https://www.payone.com/datenschutz/.


AfterPay

To complete the payment process, we send the payment data provided by you to Arvato Payment Solutions GmbH, Gütersloher Strasse 123, 33415 Verl, Germany ("AfterPay").

If you decide to make a purchase and pay AfterPay on receipt of the invoice, you grant your consent for us to send the information to AfterPay to complete the purchase. AfterPay will review your data and send them to credit agencies if there is a justified interest in doing so. Naturally, your data will be collected, processed and saved with great care and in compliance with current data protection regulations. Paypal and Paypal Express

You have the option to choose PayPal or PayPal Express as payment method during the order process.

If you choose PayPal, after you have clicked on "Buy" in the order process, you will automatically be forwarded to the PayPal website, which is operated by PayPal (Europe) S.à r.l. et Cie, S.C.A. Data will be exchanged during this forwarding process. Personal data such as name, invoice total and delivery address will be forwarded to PayPal.

However, if you have chosen PayPal Express, your shipment and invoicing data, which are held by PayPal, will be used to complete the purchase. When you click on "Direct to PayPal", the PayPal login mask will appear. In this case, the login data are not exchanged via the servers of Bültel Worldwide Fashion GmbH & Co. KG, but directly with PayPal. You must then login using your PayPal account data and select the correct delivery and invoicing address. You will then be returned to the camel active website where you can conclude your purchase. PayPal automatically sends us the delivery address, e-mail address and other customer data which we require to complete the order.

Furthermore, PayPal will collect your IP address and information about the computer or device which you use to access your PayPal account or for using PayPal services.

There are various ways of contacting us and you can also reach our customer service department by phone or e-mail. We also provide you with a contact form on our website for this purpose. In this case, we will collect your name, e-mail address, telephone number, customer, order and item number as well as any other information which you send to us.

If you contact us by telephone, telephone calls may be recorded for quality assurance purposes. Please also refer to our information relating to your right to cancel for reasons which may relate to your specific situation.

If you object to such use, your data will be locked from further data processing for marketing purposes. We would like to point out that in exceptional cases, marketing material may be sent out for a brief period after the receipt of your objection. This is due to technical reasons as a result of the preparation time required for selection and does not mean that we have not implemented your objection.


Newsletter

On our website, you can subscribe to receive the camel active newsletter, which contains a great deal of information and news about our range of products and services. Vimeo video platform

On our website, we use the function to embed Vimeo videos provided by Vimeo LLC, 555 West 18th Street, New York 10011 ("Vimeo").

The plugins are marked with a Vimeo logo, for example in the form of the letter "V" or the "vimeo" sign.
